Ping Identity recognizes the importance of trust and transparency in the use and disclosure of customer data. Like any other company, we may occasionally receive a request from a government agency, regulatory body, or law enforcement authority (collectively, a “Government Agency”) seeking access to electronic data or information submitted by a Customer and/or its users to our products (“Customer Data”). These Guidelines generally address how we respond to such requests. For purposes of clarity, these guidelines do not apply to requests for information by our customers, our customers’ end users, civil litigants, or criminal defendants.


GUIDELINES

Trust and Transparency. Trust and transparency drive everything we do. The protection of our Customer Data is paramount, and our comprehensive privacy and security program is designed to protect Customer Data against unauthorized access or disclosure. Please review our Transparency Report below describing Government Agency requests for disclosure that we have received.

Notification to Customers. We strongly believe that any Government Agency seeking access to Customer Data should address the request directly with that customer whenever possible. Accordingly, we refer the requesting Government Agency to the affected customer whenever possible, so that the customer has an opportunity to process the request itself and/or seek legal remedies. Regardless, if we receive a request for Customer Data from a Government Agency, we notify the affected customer to allow the customer to seek a protective order or other appropriate remedy, unless we are expressly prohibited from doing so by applicable law.

Lawful Requests. We require Government Agencies to follow the required legal process under applicable law in order to request Customer Data, such as issuing the request via a subpoena, court order, or search warrant. We review each government request for Customer Data on a case-by-case basis and only comply if and to the extent we determine the request is lawful. Where we believe a government request for Customer Data is invalid or unlawful, we try to challenge it. When reviewing the lawfulness of a government request, we take into account all applicable laws.

Emergency. We may disclose information to Government Agencies in the case of an emergency where there is a danger of death or serious physical injury to a person that we may have information necessary to prevent. We will evaluate emergency disclosure requests on a case-by-case basis in compliance with applicable law.
